The Italian crypto tax calculator determines the substitute tax on capital gains realized from sale of Bitcoin, Ethereum, stablecoins and other crypto-assets, applying the new 33% rate from 2026 (Italian Budget Law 2025, L. 207/2024 art. 1 paragraph 24) for general crypto-assets, and 26% for EMT (E-Money Token) euro stablecoins issued by European regulated electronic money institutions (MiCA Regulation EU 2023/1114). Until 2025 the rate was unified 26% (Italian Budget Law 2023, L. 197/2022) with €2,000 annual exemption now abolished. Crypto-assets are qualified as miscellaneous income per art. 67 lett. c-sexies TUIR, with mandatory RW form filing for foreign exchange or self-custody wallet holdings, and 0.2% annual stamp duty on average balance (DL 24/2011 art. 19). Note: this is Italy-specific crypto taxation. The US treats crypto as property (IRS Notice 2014-21) with capital gains rates 0/15/20% LTCG (>1 year) or ordinary income (<1 year), wash sale rule doesn't currently apply to crypto.
Mathematical formula
The calculation follows the new 2026 fiscal structure:
- Capital gain: G = Sale value − Purchase value (net of commissions)
- Tax on generic crypto-assets 2026: T = G × 33% (LdB 2025 L. 207/2024)
- Tax on EMT euro stablecoins: T = G × 26% (art. 1 paragraph 24 LdB 2025)
- Net gain: N = G − T
- Annual stamp duty: B = Average holding × 0.2%
- Loss compensation: only crypto-on-crypto, 4 years (D.Lgs. 461/1997 art. 6)
Key 2026 difference vs 2023-2025: rate rises from 26% to 33% for generic crypto (Bitcoin, Ethereum, altcoin, NFT, DeFi tokens), remains at 26% only for EMT (E-Money Tokens) issued by regulated euro institutions like EURT, EURC. The €2,000 annual exemption, valid 2023-2025, is abolished from 2026: every euro of gain is taxed.
History and context of Italian crypto taxation
Crypto taxation in Italy has undergone complex evolution: until 2022, Italian Revenue Agency treated cryptocurrencies similarly to foreign currencies (Resolution 72/E of 2/9/2016 and Interpello Response 956-39/2018), taxing them at 26% only if value exceeded €51,645.69 for more than 7 consecutive days. The Italian Budget Law 2023 (L. 197/2022 art. 1 paragraphs 126-147) systematically reformed the matter, qualifying crypto-assets as miscellaneous income (art. 67 TUIR lett. c-sexies) with 26% rate and €2,000/year exemption. The Italian Budget Law 2025 (L. 207/2024 art. 1 paragraphs 24-29) introduces from 2026: 33% generalized rate, abolition of exemption, 26% favored regime for euro EMT. The European MiCA Regulation (Markets in Crypto-Assets, EU Reg. 2023/1114) classifies crypto assets in EMT, ART (Asset-Referenced Token) and other tokens. Five worked examples
Example 1 — Bitcoin purchased €10,000 sold €25,000 in 2026. Capital gain €15,000. 33% tax = €4,950. Net €10,050. Annual stamp 0.2% = €50 (on €25,000). Under 2025 regime: €13,000 taxable (15,000 - 2,000 exemption) × 26% = €3,380. 2026 difference: +€1,570 tax compared to 2025.
Example 2 — Ethereum €5,000 to €12,000 in 2026. Capital gain €7,000. 33% tax = €2,310. Net €4,690. 2025 comparison: 5,000 × 26% = €1,300 (post €2,000 exemption). Difference +€1,010.
Example 3 — EUR Coin (EURC) stablecoin €50,000. EMT euro issued by Circle. Even if value increased marginally for staking interest 2%: €1,000 capital gain × 26% (EMT) = €260. Reduced rate vs 33% generic.
Example 4 — Bitcoin mining income €8,000/year. Crypto mining income is "miscellaneous income" art. 67 TUIR, taxed 33% from 2026 = €2,640. As business income if organized activity, ordinary IRPEF regime 23-43%.
Example 5 — Loss compensation. Bitcoin capital gain €10,000 + Solana loss -€3,000 (both crypto, 4 years). Net taxable €7,000 × 33% = €2,310. Tax savings €990 vs gross taxation. Crypto losses do NOT offset stocks/ETF gains (separate regimes D.Lgs. 461/1997).
Model limitations
The calculation has simplifications: exchange commissions: 0.1-1.5% trading fees Binance/Coinbase/Kraken reduce effective gain. Cost basis: FIFO or weighted average cost tracking required for multiple purchases. RW form: foreign exchange holdings (Binance, Kraken, Coinbase, Bybit) or self-custody wallets (Ledger, Trezor) require fiscal monitoring declaration art. 4 DL 167/1990. Crypto-to-crypto swap: every swap (BTC→ETH) is considered fiscal realization (Circular 30/E 2023), not just fiat withdrawal. Staking, lending, airdrop: specific aspects, generally "miscellaneous income" art. 67 with same regime. Inheritance tax: mortis causa crypto transfer subject to inheritance tax (D.Lgs. 346/1990) with €1M exemption per direct relative.
Common mistakes
- Ignoring RW form: omitted fiscal monitoring of foreign exchanges sanctioned 3-15% of value (DL 167/1990 art. 5), 6-30% for black list countries.
- Not tracking every swap: crypto-to-crypto exchange is fiscal realization, not just EUR conversion.
- Confusing 2025 exemption and 2026 abolition: from 2026 every euro of capital gain is taxed 33% (except EMT 26%).
- Compensating crypto losses with stocks/ETF: separate regimes D.Lgs. 461/1997, not mutually offsetable.
- Underestimating 0.2% stamp duty: applies even if value doesn't increase, on annual average wallet/exchange holding.
Practical applications
- Plan crypto capital gain realization before 2026 for 26% vs 33% rate.
- Calculate substitute tax on Bitcoin, Ethereum, altcoin for Modello Redditi PF.
- Evaluate converting portfolio portion to EMT euro stablecoin (EURC, EURT) for 26% rate.
- Estimate annual 0.2% stamp duty on wallet/exchange average holding.
- Plan crypto tax loss harvesting strategy to offset gains within 4 years.
- Correctly file RW form for foreign exchange or self-custody wallet holdings.
- Decide between mining as miscellaneous income or business activity (VAT with ordinary or forfettario regime).
