How to calculate Italian unused leave monetization lets Italian residents and expats estimate the amount the employer must pay at the end of the employment relationship for vacation and permits (ROL/ex-holidays) not used during the contract. The base formula is M = (Salary / divisor × vacation_days) + (Salary / (divisor × 8) × ROL_hours), gross of INPS employee contributions 9.19% (standard rate) and IRPEF taxation. The Italian regulation is governed by art. 10 D.Lgs. 66/2003 and art. 36 of the Italian Constitution, with non-disposability bond established by Cassation Joint Sections 95/2014. Comparable systems: US PTO payout (varies by state, mandatory in California per Labor Code §227.3, optional in Texas), UK statutory holiday pay per Working Time Regulations 1998, German Urlaubsabgeltung per BUrlG §7.
Calculation formula
Calculation proceeds in three steps. First: daily wage = monthly_salary / divisor, where divisor is set by applied Italian CCNL (26 for 6-day week, 22 for 5-day, sometimes 21 or 20). Second: vacation_value = daily_wage × residual_days. Third for ROL hours: ROL_value = (daily_wage / 8) × ROL_hours. For salary €1,800 with divisor 22: daily wage = €81.82. For 12 vacation days + 16 ROL hours: €981.82 + €163.64 = €1,145.45 gross.
On total amount apply: INPS employee contributions 9.19% (standard rate, can rise to 9.49% for income >€52,190/year with additional 1% solidarity), employer contributions 23.81% (employer cost, not deducted from net), and IRPEF taxation. For taxation usually applies the separate Italian taxation art. 17 TUIR DPR 917/86 (like TFR), using average rate of last 5 years. Alternatively cumulative IRPEF if more convenient. US comparable: PTO payout is taxed as ordinary wages per IRS Publication 15.
History and Italian regulatory context
Vacation right is established by art. 36 Italian Constitution ("the worker has the right to weekly rest and annual paid vacation, and cannot waive them"). Specific regulation in D.Lgs. 66/2003 implementing EU Directive 2003/88/CE: minimum 4 weeks annually, of which 2 to be used within the year and 2 within following 18 months (art. 10). Italian Cassation Joint Sections 95/2014 consolidated rule: monetization is allowed ONLY at termination, not during (to avoid circumvention of right to rest).
For Italian public sector, D.L. 95/2012 art. 5 c. 8 (Spending Review) generally prohibits monetization, except retirement, death, resignation cases. Cassation 14037/2017 extended ban to public managers. In private sector, contractual freedom is broad but bound by no-prior-waiver. At 2024 Italian INPS records about 1.2 million leave payouts/year with average €450 (INPS Annual Report 2024). System similar to French (Code du Travail L3141-28) but more favorable to employee than German (BUrlG §7). US comparable: 24 states require payout per state Labor Department data.
Italian CCNL divisors and salary calculation table
Standard divisors per main Italian CCNL contracts:
| Italian CCNL | Week | Divisor | Vacation/year | ROL/year |
|---|---|---|---|---|
| Metalworkers Industry | 5 days × 8h | 22 | 4 weeks (20-24 days) | 8 days (64h) |
| Commerce Tertiary | 5 days × 8h | 22 | 4 weeks (22 days) | 4 days (32h) |
| Construction | 5 days × 8h | 22 | 4 weeks | 4 days |
| Banking ABI | 5 days × 7.5h | 22 | 26 working days | 15h |
| Public sector | 5 days × 7.2h | 22 | 32 days + 4 holidays | n.a. |
| Tourism Federalberghi | 6 days × 6.5h | 26 | 26 working days | 32h |
Reference table for gross calculation (salary and standard divisor 22, 12 residual days):
| Monthly salary € | Daily wage € | 12 days vacation € | Net IRPEF separate 23% |
|---|---|---|---|
| 1,200 | 54.55 | 654.55 | 458.18 |
| 1,800 | 81.82 | 981.82 | 687.27 |
| 2,500 | 113.64 | 1,363.64 | 954.55 |
| 3,500 | 159.09 | 1,909.09 | 1,336.36 |
5 verified numerical examples
- Italian Metalworkers employee, salary €1,500, divisor 22, 8 vacation + 16h ROL: daily wage €68.18; vacation €545.45; ROL €68.18/8 × 16 = €136.36. Gross €681.82, INPS 9.19% = -€62.66, contrib net €619.16. IRPEF separate 23% = €476.75 net.
- Italian Commerce employee, salary €2,200, divisor 22, 12 vacation days: daily wage €100; vacation = €1,200. INPS 9.19% = -€110.28. Net contrib €1,089.72. IRPEF 27% = €795.50 net final.
- Italian executive salary €5,000, divisor 22, 18 vacation + 32h ROL: daily wage €227.27; vacation €4,090.91; ROL €909.09. Total gross €5,000. INPS 9.49% = -€474.50. IRPEF separate 38% = €2,808.03 net.
- Italian banking ABI, salary €2,800, divisor 22, 5 vacation + 7.5h ROL: daily wage €127.27; vacation €636.36; ROL €127.27. Total gross €763.64.
- Italian public retirement: salary €2,500, 30 vacation days accrued. Spending review exception (D.L. 95/2012). €113.64 × 30 = €3,409.09 gross, separate net 27% = €2,488.64.
Model limitations
- Termination only: Italian Cassation SS.UU. 95/2014 clarifies that monetization of accrued vacation is NOT allowed during employment, only at end. Exception: vacations beyond legal minimum (over 4 weeks) can be subject to individual agreement, similar to US "use-or-lose" PTO.
- Italian public sector ban: D.L. 95/2012 art. 5 c. 8 generally prohibits monetization for public employees, except retirement, death, resignation, dismissal for just cause.
- Separate vs cumulative taxation: Italian INPS always calculates with separate taxation (TUIR art. 17), but in declaration taxpayer can opt for cumulative IRPEF if more favorable (rare for medium-high incomes).
- Right expiration: some Italian CCNLs provide expiration of unused days after 18-30 months (art. 10 D.Lgs. 66/2003). Verify own CCNL before accruing too long, similar to US "use-it-or-lose-it" policies in some states.
Common errors
- Confusing monthly vs annual divisor: divisor is daily for monthly calculation (22 or 26), not annual.
- Including variable items in salary: for monetization use fixed contractual salary, excluding overtime, one-time bonuses, variable allowances.
- Calculating ROL as vacation: ROL is in hours, not days. Conversion: ROL/8 = equivalent days for standard 8h/day ROL.
- Demanding monetization during employment: prohibited by Italian Cassation SS.UU. 95/2014, except agreements on vacations exceeding legal minimum.
- Treating mid-week holidays as vacation: holidays falling in vacation period are recovered (vacation extends 1 day) per consolidated jurisprudence.
- Not applying INPS employee: monetization is social-security taxable at 9.19% standard, reducing net by 9-10%.
Numbered practical applications
- Italian Metalworkers termination, 8 vacation + 16h ROL, salary €1,800: gross €81.82×8 + €81.82/8×16 = €818.18. Net IRPEF separate 23%: €581.82.
- Italian public retirement, 25 days vacation: spending review exception. Salary €2,200, divisor 22, gross €2,500.
- Italian resignation during year with proportional vacation: matured vacation = year_days × (months_worked/12).
- Italian dismissal for just cause: matured vacation remains monetizable (art. 36 Constitution inviolable protection).
- Italian CCNL change during year: vacations matured under old CCNL at old divisor, new under new.
- Italian maternity preceding termination: vacation matured during mandatory abstention is integrally enjoyed by law (D.Lgs. 151/2001 art. 22).
- Verification with payroll software: Italian Zucchetti, INAZ, TeamSystem apply automatic formulas. Employee can request detailed prospect (LUL).
